Tanning Indoor Facility Permit
You need a permit to run a place where ultraviolet (UV) radiation devices (tanning machines) are used, offered or made available for use and for which a fee is charged either directly or indirectly. This rule is from the NYC Department of Health and Mental Hygiene (DoHMH).
Places like tanning parlors, salons, gyms, health clubs, apartment buildings, condos, country clubs and hotels need this permit.
You do not need this permit if a qualified health professional uses UV radiation devices to treat medical conditions.
Note:
- Direct fee: This is a fee paid specifically for the use of a UV device.
- Indirect fee: This is a fee paid to places like hotels, condos, private clubs or apartment buildings where tanning machines are available for members, guests or residents.

- Permit application fee: $120
- Inspection fee: $200 for each UV unit
- Biannual renewal fee: $120 plus $200 for each UV unit

- If you turned in your application in person, the Department of Consumer and Worker Protection (DCWP) will give you a receipt.
- If you turned in your application online, you will get a receipt by email.
- You can check your application status by calling the NYC Department of Health, Office of Public Health Engineering at 347-396-6001.
- All tanning facility operators using UV equipment must follow Article 177 of the NYC Health Code.
NYC Health Code - Article 177 (PDF) - All tanning establishment operators, and employees who operate a UV device or who assist patrons who operate a UV device, must complete training in the safe operation of a UV device approved by the City.
Approved UV Device Training Providers (PDF) - Operators must give every customer a copy of the NYC Department of Health and Mental Hygiene (DOHMH) fact sheet about the health risks of indoor tanning.
Indoor Tanning Health Risk Information for Customers (PDF) - Every year, operators must have every customer read and sign a DOHMH Indoor Tanning Patient Acknowledgement Form. The operator or an employee must also sign the form. Keep a current signed form on file for all customers using a tanning device.
Patron Indoor Tanning Acknowledgement Form (PDF) - No one under age 17 can use a tanning machine (UV device). Operators must check a government-issued photo ID for all customers age 18 or older. Customers age 17 must have a consent form signed by a parent or legal guardian.
Tanning Consent Form for Minor Age 17 (PDF) - The operator must report all injuries or illnesses from using a UV device to the DOHMH Office of Public Health Engineering within 24 hours. Reportable injuries and illnesses include eye injuries, burns and any other illness or injury needing medical care. Keep all injury reports on file for two years.

Indoor Tanning Establishment Patron Record Form (PDF) - Each permitted tanning facility will be inspected every two years.
- Effective June 17, 2014, establishments with permits from the State of New York will have their permits transitioned to under the jurisdiction of the DOHMH. Their permits will be valid until two years from when they were issued by New York State. Upon expiration, they will renew with the DOHMH.

Gather documents: Collect all the documents you need to apply for the permit.

Provide UV device information: When applying online, you need to give details about all UV devices in your facility.

Create an account: Sign up with the NYC Online Licensing system. Have your credit or debit card ready for payment. You can save and return to incomplete applications.

Pay and submit: Use a credit or debit card to complete and submit your application.

Complete forms: Fill out the Application for a Permit and the Supplemental Form (including UV Device Manifest). Gather all required documents.

Submit documents and payment: Bring the completed renewal notice, worker's compensation information, other required documents and payment to the DCWP Citywide Licensing Center.

You will receive a renewal notice three months before your permit expires. Every time you renew your permit, you will need to update the device information (manifest) for all UV devices in your establishment, if applicable. If you renew online, you can enter this information when you renew your permit. If you renew in person, you must submit the separate manifest sheet you received with your renewal. Payment for the permit fee and each device must be submitted.

Renewals may be submitted online via the NYC Online Licensing system. Registration is required. You will not be permitted to renew a permit if you have outstanding fines. You can pay fines online before renewing.

To renew online for the first time, you will need the Personal Identification Number (PIN) found on your Renewal Notice for each permit or license you hold. The PIN will allow you to link your existing records to one single online account. You only need to use your PIN to link to each permit or license record once.
If you do not have access to your Renewal Notice, you may obtain your PIN(s) by completing an online PIN Request Form or by calling 311.
Note: If you need to upload any documents, you will be prompted to download the Microsoft Silverlight application.

- You may renew your permit in person at the DCWP Citywide Licensing Center. If you send someone to renew for you, they must present an Authority to Act on your behalf.
